Once the Administrative Law Judge has made a decision on your appeal, a Proposed Decision will be issued. It will explain the issue of the appeal, a brief summary of the testimony given during the hearing, and the judge's decision.

What if I disagree with the proposed decision?

If you disagree with the Proposed Decision, you may request a review. Your attorney, representative or you may request a review. The Department also may request a review if they disagree with the Administrative Law Judge's decision.

Write a letter stating that you want to request a review and send or fax it to the Appeals Section at the address below. It must be postmarked, faxed or emailed within 10 calendar days of the date on the Proposed Decision.  The date is located just above the Administrative Law Judge's signature.

If your review request is received within the appropriate timeframes, you will get a letter indicating that your case is under review. Once a decision has been reached on your review, you will be sent a Final Decision. The Final Decision will explain the outcome of the review process.

What if I requested a review and disagree with the final decision?

If you requested a review and disagree with the Final Decision, you may file a petition in district court in the county you live in. You must file your petition within 30 days of the date on the Final Decision.
